Special Needs Trusts

Planning for families with children who have a disability can be particularly challenging. Our experience in special needs trust law enables us to provide guidance on the types of trusts available to meet the needs of a parent who would like to provide for a child with special needs who is a SSI or Medicaid recipient, without affecting the child's governmental payments.

Trust Options

We will discuss the following trust options available for individuals with a disability:

  • Wholly Discretionary Trust
  • Community Fund Management Foundation Master Trust

Wholly Discretionary Trust

This type of trust allows the creator to transfer assets to a trust for the benefit of a child with a disability. The trust can be used to protect the beneficiary's governmental benefits, while also providing for the beneficiary's supplemental needs.

Community Fund Management Foundation Master Trust

This trust is a version of the Wholly Discretionary Trust, managed by the not-for-profit Community Fund Management Foundation (CFMF) in Cleveland, Ohio. The trust has a minimum initial investment of $15,000 and an application fee. The assets are managed by a professional corporate trustee.
