Chapter 7 bankruptcy, also known as liquidation bankruptcy, allows you to eliminate most of your debts. This type of bankruptcy is best suited for individuals who have a significant amount of unsecured debt, such as credit card debt, medical bills, and personal loans. In a Chapter 7 bankruptcy, a trustee is appointed to sell any non-exempt assets you have to pay off your creditors. However, most people who file for Chapter 7 bankruptcy do not have any non-exempt assets, so they are able to keep all of their property.
Chapter 13 bankruptcy, on the other hand, is a reorganization bankruptcy. It allows you to create a plan to repay a portion of your debts over a period of three to five years. This type of bankruptcy is best suited for individuals who have a steady income and want to keep certain assets, such as a home or car, that they might otherwise lose in a Chapter 7 bankruptcy. At the end of the repayment period, any remaining debts are discharged.
